DISTANCE SELLING AGREEMENT AND PRE-CONTRACTUAL INFORMATION FORM

1. Introduction and Legal Basis

This notice sets out the pre-contractual and contractual information that must be provided under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCR 2013") regarding the sale of goods conducted by NETAYAT LIMITED ("we", "us", "our") via https://www.mianotti.com ("Site") without face-to-face communication, i.e., via the internet.

This information forms part of the contract concluded between us for every order you place and is evaluated together with our Distance Selling Terms and Conditions, Returns and Cancellation Policy, and Privacy Policy.

By placing an order, you acknowledge that you have read and understood this information before the contract is concluded.

3. Products, Pricing, and Total Cost

Product descriptions, images, sizing information, and fabric details are provided on the relevant product page on the Site.

The stock status of products and estimated production or delivery times are shown at the checkout stage or confirmed via email.

The total price payable, including applicable UK VAT and delivery charges, is displayed at the checkout stage before you confirm your order.

No additional fees will be charged without your express consent before you complete your purchase.

For example:

  • Optional alteration services

  • Expedited shipping services

If there is an additional charge for services such as these, your consent will be obtained before you complete your purchase.

4. Payment, Delivery, and Performance of the Contract

Payment

Payments are processed securely through Shopify's payment infrastructure. Examples include:

  • Shopify Payments

  • PayPal

  • Klarna

For custom orders, a deposit/pre-payment agreed upon may be requested. The remaining amount must be paid before the product is shipped or the final fitting takes place.

Delivery

Estimated delivery or completion times are shown at the checkout stage or stated in your order confirmation.

These times are estimates and may vary, particularly for made-to-order or custom-designed products that require a production process.

Performance of the Contract

Unless a longer period is expressly agreed upon for a custom order, we will deliver the products no later than 30 days from the date of the contract.

If we anticipate that we will be unable to meet the agreed delivery date, we will inform you and offer:

  • A new delivery date,

  • A refund, or

  • The option to cancel the order.

5. Right to Cancel — Standard Products

For standard and non-customized products, you have the right to cancel your order within 14 days of the date you receive the products without giving any reason, in accordance with CCR 2013.

To exercise this right, you may notify us using the sample cancellation form in Section 9 or by making any other clear written statement (e.g., by sending an email to mianotti@netayat.co.uk).

We will acknowledge receipt of your cancellation notice without delay.

If you cancel your order, you must return the products within 14 days of the cancellation notice and at your own expense, unless the products are faulty.

We will refund all payments received within 14 days after we receive the products back or receive proof of return.

Standard delivery charges will also be refunded. However, if you chose a more expensive delivery method, the additional charge exceeding the standard delivery fee will not be refunded.

6. Made-to-Order and Custom Products: Exception

In accordance with Regulation 28(1)(b) of the CCR 2013, the right to cancel does not apply to products made to the customer's special requests or clearly personalized.

Most of our wedding dresses fall into this category because they are produced or customized according to your:

  • Measurements,

  • Choice of fabric,

  • Choice of color, and

  • Design preferences.

Before placing a custom order, we will clearly state that the product is exempt from the 14-day right to cancel.

Furthermore, we will state that once production has begun, the order cannot be cancelled unless the product is faulty, damaged, or not in accordance with the described specifications.

We will confirm this exemption in writing (including by email) as part of your order confirmation, in compliance with CCR 2013.

7. Duration and Termination of the Contract

Each contract concluded under this notice relates to a single order and continues until the order is:

  • Fully performed,

  • Cancelled,

  • Refunded, or

  • Terminated in accordance with this notice, our Distance Selling Terms and Conditions, or applicable law.

Unless otherwise agreed with you separately in writing, there are no ongoing subscriptions or recurring payment obligations.

8. Complaints and Dispute Resolution

If you have a complaint, we ask that you first contact us using the contact details in Section 2 so that we can try to resolve the issue directly.

Your statutory rights under the Consumer Rights Act 2015 are not affected by this process.

Consumers in the UK may also benefit from an alternative dispute resolution (ADR) provider, if available, or the relevant online dispute resolution service.

This notice and the associated contract are governed by the laws of England and Wales and are subject to the jurisdiction of the courts of England and Wales.

However, this does not affect your right as a consumer to bring proceedings in local courts elsewhere in the UK.
